3. Service Agreements and Contracts
Quotes and Estimates
- All quotes and estimates provided are valid for 30 days unless otherwise specified
- Quotes are based on information provided and initial assessments; final pricing may vary based on actual conditions discovered during service
- Estimates do not constitute a binding contract until a formal service agreement is executed
- We reserve the right to refuse service at our discretion
Service Contracts
- All services require a signed service agreement or contract
- Contracts will specify the scope of work, timeline, pricing, payment terms, and warranties
- Any changes to the agreed scope of work must be documented in writing and approved by both parties
- Additional work discovered during service execution will be documented and requires customer approval before proceeding
4. Pricing and Payment Terms
Payment
- Payment terms will be specified in your service contract
- We accept cash, checks, credit cards, and approved financing options
- Deposits may be required before work commences, typically 25-50% of total project cost
- Final payment is due upon completion and customer approval of work, unless financing is arranged
- A convenience fee may apply to credit card payments over certain amounts
Late Payments
- Payments not received within 30 days of invoice date may be subject to a late fee of 1.5% per month or the maximum allowed by law
- We reserve the right to place a mechanic's lien on your property for unpaid balances
- Collection costs, including attorney fees, may be added to unpaid balances
Pricing Changes
We reserve the right to change our prices at any time. Pricing changes will not affect existing signed contracts or quotes within their validity period.
5. Scheduling and Cancellations
Scheduling
- Service dates are estimated and subject to change due to weather, material availability, or unforeseen circumstances
- We will make reasonable efforts to notify you of any schedule changes as soon as possible
- Emergency services are subject to availability and additional fees may apply
Cancellations by Customer
- Written notice of cancellation must be provided
- Cancellations made less than 48 hours before scheduled service may incur a cancellation fee
- Deposits may be non-refundable if work has commenced or materials have been ordered
- Refund eligibility will be determined based on work completed and materials purchased
Cancellations by Company
We reserve the right to cancel or reschedule services due to weather conditions, safety concerns, or other unforeseen circumstances. In such cases, deposits will be refunded or applied to rescheduled services.
6. Customer Responsibilities
As a customer, you agree to:
- Provide accurate information about your property and service needs
- Ensure safe and reasonable access to work areas
- Remove or secure personal property in work areas
- Disclose any known hazardous materials or conditions (asbestos, lead paint, etc.)
- Maintain clear access for our vehicles and equipment
- Secure pets during service visits
- Provide necessary permits or notify us if permits are required
- Review and approve work upon completion
- Maintain installed systems according to manufacturer guidelines
7. Warranties and Guarantees
Service Warranty
- We warrant our workmanship for periods specified in individual service contracts
- Typical workmanship warranties range from 1-10 years depending on the service
- Warranties cover defects in workmanship but do not cover damage from normal wear, misuse, or acts of nature
- Warranties are non-transferable unless specified in writing
Manufacturer Warranties
- Materials and products come with manufacturer warranties
- We will assist with manufacturer warranty claims but are not responsible for manufacturer warranty coverage or claims
- Warranty documentation will be provided upon project completion
Warranty Exclusions
Warranties do not cover:
- Damage caused by customer neglect or failure to maintain
- Damage from extreme weather events or acts of God
- Damage from alterations or repairs made by others
- Normal wear and tear
- Cosmetic issues that do not affect functionality
8. Liability and Indemnification
Insurance
Enhance Home Solutions maintains appropriate liability insurance and workers' compensation coverage. Proof of insurance is available upon request.
Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claims arising from our services shall not exceed the amount paid for those services
- We are not liable for indirect, incidental, special, or consequential damages
- We are not responsible for pre-existing conditions, hidden defects, or damage not discoverable during initial inspection
- We are not responsible for personal property not removed from work areas
Indemnification
You agree to indemnify and hold harmless Enhance Home Solutions, its officers, employees, and contractors from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Inaccurate information provided by you
- Failure to disclose hazardous conditions
- Third-party claims related to your property
9. Permits and Compliance
- We will obtain necessary permits for work when required, and permit costs will be included in your contract
- All work will comply with applicable local, state, and federal building codes and regulations
- Customer is responsible for HOA approvals if applicable
- Work may be subject to inspection by local building authorities
- We maintain all required state and local contractor licenses
- Proof of licensing and insurance available upon request
10. State-Specific Contractor Regulations
Florida-Specific Provisions
As a Florida-based contractor, we comply with Florida Statute Chapter 489 and the following:
- Licensing: We maintain active Florida contractor licenses as required
- Notice of Commencement: Florida's lien law requires recording of Notice of Commencement for applicable projects
- Direct Filing: Subcontractors and material suppliers may file liens directly on your property
- Final Payment: Florida law requires holding final payment until receipt of contractor's final affidavit and releases from subcontractors
- Hurricane Season: Work schedules may be affected by hurricane warnings and weather conditions per Florida Building Code
- Right to Cancel: You have 3 business days to cancel contracts signed at locations other than our permanent place of business
Right to Cancel (Federal and State Laws)
Under federal law and many state laws, you may have the right to cancel certain contracts:
- 3-Day Right to Cancel: For contracts signed at your home or away from our permanent business location, you have 3 business days to cancel without penalty (Federal Trade Commission Rule)
- Notice Requirement: Cancellation must be made in writing and sent to our business address
- Exceptions: Emergency services and contracts fully performed before cancellation period expires may not be subject to cancellation
- Refund Timeline: If you cancel within the cooling-off period, we will refund any payments within 10 business days

11. Property Access and Liens
Access Rights
By contracting our services, you grant us reasonable access to your property during agreed-upon hours to perform work. We will respect your property and minimize disruption.
Mechanic's Liens
In accordance with applicable state law, we reserve the right to file a mechanic's lien on your property for unpaid services. You will receive appropriate lien notices as required by law.

- You may be required to receive lien waivers from subcontractors before final payment
- Some states require bond or other security in lieu of lien rights
12. Intellectual Property

18. Waiver

These Terms, along with our Privacy Policy and any signed service contracts, constitute the entire agreement between you and Enhance Home Solutions regarding our services and supersede all prior agreements and understandings.
20. Assignment
You may not assign or transfer these Terms or your service contract without our written consent. We may assign these Terms or any service contract to a successor or affiliate without your consent.
21. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
22. Emergency Services
Emergency services are provided on a best-efforts basis and subject to availability. Emergency service fees apply and will be disclosed before work commences. We prioritize safety and will assess emergency situations to determine appropriate response.
23. Financing
If you choose to finance your project through our approved lenders:
- Financing is subject to credit approval
- Terms and rates are determined by the lender
- We are not responsible for financing terms or approval decisions
- You are responsible for understanding and complying with financing agreements
- Truth in Lending Act (TILA) disclosures will be provided by the lender
- Some states require specific contractor-arranged financing disclosures
24. Testimonials and Reviews
By providing feedback, reviews, or testimonials:
- You grant us permission to use your feedback for marketing purposes
- We may edit testimonials for length or clarity
- You confirm that your feedback is truthful and based on your actual experience
- You may request removal of your testimonial at any time
